Mother of Merch operates as a trading division and service brand under The Mother, specifically relating to merchandise products, merchandise fulfilment, and merchandise-related services.
By accessing our website, purchasing products, booking services, or engaging with The Mother in any capacity, you agree to be bound by these Terms and Conditions.
If you do not agree to these Terms and Conditions, please do not use our website or proceed with an order or booking.

All services are subject to availability and may be amended, withdrawn, or updated at any time without notice.
The Mother reserves the right to refuse or cancel any booking, project, service, or order at its discretion where a request is not feasible, suitable, legally compliant, aligned with our services, or operationally achievable.
3. Merchandise Sales
Mother of Merch provides merchandise, products, and related services to businesses and individuals through a range of sales channels. Prices, products and services are subject to change without notice and are offered subject to availability.
All orders, whether placed via our website, online shop, forms, discovery calls, email, invoice, social media, or in person at events, are subject to acceptance. We reserve the right to refuse or cancel any order at our discretion, including where a request is not feasible, suitable, or aligned with our services, or where materials, suppliers, production capacity, or timelines are unavailable.
Orders placed directly with The Mother or Mother of Merch via forms, invoices, email, strategy calls, or other direct communication are provided on a business-to-business (B2B) basis.
Orders placed through the Mother of Merch online shop may be made by businesses or consumers and may be subject to additional statutory consumer rights where applicable.
Where merchandise is fulfilled on behalf of a client via the client’s own website, platform, or sales channel, the contract of sale exists between the end customer and the client. In these circumstances, the client’s own terms, pricing, and refund policies apply unless otherwise agreed in writing.
4. Payment Terms
Payment must be made in full at the time of order for all physical merchandise products unless otherwise agreed in writing.
For services, sessions, strategy work, workshops, event services, or consultancy, payment plans may be offered at the discretion of The Mother and will be confirmed in writing where applicable.
No work will commence, and no materials, venues, suppliers, or production elements will be booked or ordered until payment has been received in full or, where a payment plan has been agreed, the first payment has cleared.
Invoices are issued following confirmation of an order, service, or booking.
An invoice does not constitute acceptance or confirmation of an order until payment has been received.
Payments may be made via credit card, PayPal, bank transfer, Stripe, or other approved payment methods.
For purchases made directly through our online store, a receipt will be provided automatically. Invoices may be requested by contacting [email protected].
5. Shipping and Delivery
Mother of Merch is a UK-based business. All delivery timeframes provided are estimates only and are not guaranteed.
Estimated delivery times are based on production timelines plus shipping and may vary depending on item type, order size, approvals, supplier availability, courier availability, delivery location, and external factors.
If you require an order to be dispatched sooner than our standard estimated timeframe, you must contact us prior to placing your order. Rush requests are subject to availability and may incur an additional fee.
Shipping costs and estimated delivery times will be disclosed at the point of purchase or invoice.
Unless otherwise specified, items are dispatched via Royal Mail Tracked 48.
The Mother and Mother of Merch are not responsible for delays caused by external factors including courier delays, customs processes, weather conditions, strikes, supplier issues, or events outside our reasonable control.
For event or in-person deliveries, responsibility transfers once items have been delivered to the agreed location or handed to the agreed recipient.
6. Intellectual Property and Image Use
6.1 The Mother Content
All content on The Mother and Mother of Merch websites, including but not limited to text, graphics, logos, imagery, downloads, resources, branding, workshops, templates, recordings, and educational materials, remains the property of The Mother unless otherwise stated.
Content may not be copied, reproduced, redistributed, resold, or reused without prior written permission.
6.2 Customer Submissions
By submitting any images, logos, text, files, videos, or other content for use within projects, merchandise, workshops, lead magnets, or creative services, you confirm that you have the legal right and permission to use those materials.
The Mother may reasonably rely on this confirmation when fulfilling work. Where content is clearly identifiable as copyrighted, trademarked, or otherwise restricted, The Mother reserves the right to refuse to use such content or request evidence of appropriate authorisation before proceeding.
Responsibility for ensuring that customer-supplied content does not infringe third-party rights remains with the customer.
Where it is identified that customer-supplied content infringes third-party intellectual property rights after work has commenced, The Mother reserves the right to cease work immediately and cancel the affected project or order.
Any costs already incurred, including but not limited to materials, supplier costs, venue costs, production time, staffing, travel, or third-party fees, are non-refundable. Any refund offered for remaining work not yet carried out is at the sole discretion of Mother of Merch.
6.3 Designs and Creative Assets
Where design, strategy, or creative services are purchased separately and paid for in full, ownership of the final approved deliverables transfers to the client unless otherwise agreed in writing.
Where artwork, concepts, mock-ups, layouts, templates, or creative assets are produced solely as part of another service or merchandise fulfilment process, all intellectual property rights remain with The Mother unless otherwise agreed.
The Mother retains the right to display completed work for portfolio, marketing, educational, promotional, and social media purposes unless otherwise agreed in writing.
6.4 Approvals and Third Party Assets
By approving any designs, proofs, concepts, mock-ups, event plans, workshop materials, or creative assets, the client confirms that all details are correct and that they hold the necessary rights and permissions for all included content.
The Mother is not responsible for errors, omissions, or rights issues identified after approval.
Where third-party tools, AI-assisted tools, fonts, stock assets, platforms, software, or licensed materials are used at the request of, or with approval from, the client, responsibility for compliance with applicable licensing terms remains with the client.
7. Ordering and Booking Process
Orders and bookings may be placed via our website, online shop, forms, email, invoices, strategy calls, discovery calls, social media, or in person. An order or booking is considered confirmed only once it has been accepted and payment has been received in accordance with these Terms and Conditions.
Customers are responsible for ensuring that all specifications, quantities, dates, delivery information, approvals, spelling, and supplied information are correct.
Due to the personalised and made-to-order nature of many services and products, changes or cancellations cannot be guaranteed once work has commenced or materials have been ordered.
Where changes are requested after confirmation, The Mother may agree to make amendments at its discretion. Any additional costs incurred must be paid before work continues.
8. Creative Coaching and Consultancy Services
Creative coaching and consultancy services include but are not limited to:

Strategy sessions
Creative consultancy
Business brainstorming sessions
Creative problem-solving support
These services are intended to provide strategic guidance, creative support, education, and idea generation.
No specific commercial outcome, financial result, business growth, audience growth, or success is guaranteed.
Implementation of any advice, strategy, or ideas discussed remains the sole responsibility of the client.
Full payment is required at the time of booking unless otherwise agreed in writing.
All bookings are non-refundable.
For online services, sessions, or calls, a minimum of 48 hours’ notice must be provided for any rescheduling request. The online service may be rescheduled once free of charge, subject to availability. Any further rescheduling requests may incur an additional fee of £50.
Where less than 48 hours’ notice is given, or in cases of non-attendance, the session may be considered forfeited without refund.
For in-person services, workshops, events, or bookings, rescheduling requests will be considered where possible. However, the client remains responsible for any non-refundable costs already incurred by The Mother, including but not limited to accommodation, venue hire, travel, staffing, supplier costs, or third-party booking fees.
Any additional costs resulting from the rescheduling may also be payable by the client.
9. Lead Magnet and Creative Asset Services
Lead magnet and creative asset services include but are not limited to:
Lead magnet creation
Creative downloads
PDF creation
Digital assets
Templates
Presentation assets
Clients are responsible for providing all required information, branding, assets, text, and approvals necessary for completion.
The Mother does not verify legal, financial, medical, industry-specific, or regulatory claims made within client-provided content.
AI-assisted tools may be used as part of the creative process.
Ownership of completed final assets transfers to the client once payment has been made in full unless otherwise agreed.
All bookings are non-refundable.
It is the clients responsibility to verify the information contained within the the aforementioned assets. AI tools may be used to provide information to create the material and as such, the client must check the information provided and use their own research and knowledge when choosing to publish the information.
The Mother will not be held responsible for any incorrect information contained within the lead magnets and creative assets.
10. Event Services
Event services include but are not limited to:

The Mother may work with third-party suppliers, venues, staffing providers, printers, couriers, entertainers, or contractors as part of delivering event services.
The Mother is not responsible for the actions, failures, delays, cancellations, or performance of third-party suppliers.
Clients remain responsible for event attendance, ticket sales, venue performance, audience behaviour, event profitability, and marketing outcomes.
Where accommodation, travel, venues, staffing, or external services have been booked specifically for a client event, these costs are non-refundable once committed.
Where an event is postponed, cancelled, or rescheduled by the client, any costs already incurred remain payable.
The Mother reserves the right to withdraw from an event or service where circumstances become unsafe, abusive, unlawful, inaccessible, or operationally unmanageable.
11. Merchandise Services
Merchandise services include but are not limited to:

Product sourcing
Merchandise fulfilment
Ecommerce merchandise support
White labelled merchandise services
The Mother and Mother of Merch act as merchandise providers, fulfilment partners, and sales support services within agreed platforms, stores, communities, or events.
While strategic guidance and promotional support may be provided, no guarantees are made regarding sales volume, audience engagement, conversion rates, revenue, or commercial outcomes.
Final product approval, pricing, and sign-off remain the responsibility of the client.
Where access is granted to groups, websites, communities, ecommerce platforms, or event systems for promotional or operational purposes, such access may be withdrawn by either party at any time.
12. Workshops and Training
Workshops, training sessions, educational content, masterclasses, and learning materials provided by The Mother are intended for educational and informational purposes only.
Participation does not guarantee specific business, financial, or commercial outcomes.
The Mother reserves the right to amend workshop content, schedules, speakers, delivery methods, timings, or materials where reasonably necessary.
Workshop materials, templates, recordings, downloads, and resources remain the intellectual property of The Mother unless otherwise agreed in writing.
These materials may not be copied, redistributed, resold, shared publicly, or reproduced without written permission.
13. White Label Services
Where The Mother provides white labelled services on behalf of another business, organisation, or event, responsibility for the final customer relationship, published policies, pricing, and customer communications remains with the client unless otherwise agreed in writing.
The Mother reserves the right to refuse requests that are not operationally feasible, legally compliant, aligned with our business values, or achievable within agreed timelines.
14. Returns and Damaged Goods
Due to the personalised and made-to-order nature of many products, returns or refunds for change of mind are not accepted where items have been customised or produced to customer specifications unless required by law.
Customers are asked to inspect goods upon receipt and report any damage or defects promptly.
For online consumer orders placed through the Mother of Merch online store, statutory consumer rights apply in accordance with UK law.
Business customers must inspect goods upon receipt and notify The Mother of any damage or defects within 5 working days of delivery.
The Mother is not responsible for errors arising from customer-approved designs, spelling, specifications, quantities, or supplied information.

15. Discovery Calls
Discovery Calls are exploratory calls designed to assess suitability for services provided by The Mother.
Discovery Calls do not constitute business advice, strategy delivery, or service commencement.
The Mother reserves the right to decline or end a Discovery Call where it is clear that the service is not a suitable fit or where abusive, inappropriate, or unreasonable behaviour occurs.
Repeated no-shows may result in booking restrictions.
16. Limitation of Liability
Nothing within these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability which cannot legally be excluded under applicable law.
Subject to the above, The Mother shall not be liable for any indirect, incidental, special, or consequential losses or damages, including but not limited to loss of profits, loss of business, loss of data, loss of opportunity, or reputational damage arising out of, or in connection, with the use of our products or services.
To the fullest extent permitted by law, total liability arising under or in connection with any product or service shall be limited to the total amount paid for the specific product or service giving rise to the claim.
The Mother does not guarantee specific commercial outcomes, financial performance, audience growth, sales, engagement, or business success.
17. Pricing and Payments
All prices are listed in GBP (British Pounds) unless otherwise stated.
Prices may vary depending on project scope, custom requirements, taxes, shipping costs, event requirements, supplier pricing, or service complexity.
The Mother reserves the right to update pricing at any time.
Any pricing changes will not affect confirmed and paid bookings or orders.
Orders and payments are considered final once confirmed, subject to the provisions set out in there Terms and Conditions and any applicable statutory rights.
18. Force Majeure
The Mother shall not be liable for any failure or delay in performing obligations where such failure or delay results from events beyond reasonable control.
This includes but is not limited to natural disasters, acts of government, internet outages, venue closures, supply chain disruptions, strikes, war, terrorism, illness, pandemics, power failures, or courier delays.

The Mother is committed to protecting your privacy.

20. Changes to Terms and Conditions
The Mother reserves the right to update or amend these Terms and Conditions at any time.

Continued use of our website, products, or services following updates constitutes acceptance of the revised Terms and Conditions.
21. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
